What states is it legal to own a stingray in your home aquarium?

I recently read that in most states in the U.S. it is actually illegal to own one in your home, but we are in the military so we move around a lot and may soon go to a state where it is legal. Why is it legal for pet stores / WalMart to sell TINY 5 gallon and below fish tanks?

However, by putting the money towards a good tank, it means you’re a serious pet owner who will be responsible in other ways (feeding, cleaning).

Why is it legal to sell these tiny containers? It’s animal cruelty.
