Is it legal to have stairs coming into kitchen in a house?

legal
tyler156 asked:

I am currently looking for a new home and seen one that i really like. However, they have a stair case in the kitchen which leads up to the bedrooms upstairs. At first thought nothing of this, a bit strange but that’s all. However a friend has told me they think that is not legal. does anyone know if this is the case?

Its legal to have stairs - what you cant have on new build is a toilet leading directly from a kitchen unless it has 2 doors seperating it xxx starlet108

You ever watch Different Strokes? They had a spiral staircase in their kitchen. txnascarguy

You can have stairs going to the roof if you wanted them and as long as they pass building and safety codes, LOL Sphinx Rising

why wouldnt it be legal? Not allowed to get a midnight snack? Take a tour of an old mansion, a lot of them had back staircases from the kitchens to the bedrooms for the servants. senorrobertoe

Maybe in new construction there are building codes that would prohibit such a design. It all depends on your local jurisdiction and it’s building codes.

This question is way too local for a forum like this. Tell us where you are located and perhaps someone familiar with your local codes could help. WhatAmI?

nothing wrong with it,although you can’t have a door at the very top of a stair case. (As people may open & walk through without realising there is a stair case!)

One other point - if there was a problem with it being like this, it would be picked up by a surveyor! Dave

Why in the world would it be illegal. It poses no safety risk. Usually your main staircase upstairs is not in the kitchen but many stairs to the basement are there. Every new house gets inspected to see if it is up to code. They would not have allowed the builder to put the stairs there if it was not alright. Once the house is built, even if the rules changed, you would be grandfathered out of that clause.

I still believe you can put a staircase where you want and do not believe you will have any problems with the house. ciza29

Rubbish. Lots of old houses have stairs which lead directly from the kitchen, some have doors, but not all. In any case, your solicitor will pick up on the legals of buying a house. Lenny

It would depend upon the housing codes where the house is I’ve seen it several times so I doubt if it is illegal and I don’t see what danger it would pose, which is more reason to doubt its illegality. It might be unattractive which is why I think it would be a local housing code issue. Laura

Check with the building codes for your city. I know in Arizona, there are models and several home built with steps coming from the kitchen, but there is another stair case coming in from another room. They were really nice homes. The only reason wld be for fire, not having another exit from the upstairs. I wld make sure the stair case has another exit other than just the kitchen. The kitchen is a potential fire area. Carol R. No reason for it not to be legal, just unusual.

Our old home used to have a set of stairs into the kitchen from the former staff quarters - it just served us as another staircase to the bedrooms. Andy
